PCT Fee Calculation

Discussion

PCT stands for Patent Cooperation Treaty. You can use the PCT Fee Calculation Sheet (Annex to the Request) to figure out how much you owe. First, most of the fees can be located here: www.wipo.int/pct/en/fees.pdf

If you’re just interested in the US Receiving Office (RO) you can also download the fees here: http://www.wipo.int/pct/guide/en/gdvol1/annexes/annexc/ax_c_us.pdf

It’s best you download the fee sheets as the fees change.

You come to Item 3 that looks like this for the International Filing Fee.

Now at the time this brief note was written the filing fee 3.i1 was USD 1453, HOWEVER if you use Electronic filing (EFS-Web without PCT-EASY.zip file) you can deduct USD 109, and if you use Electronic filing (EFS-Web with PCT-EASY.zip file) you can deduct USD 218. Not a huge amount but every dollar helps.
As shown above we have indicated to the RO that discount by the 1453-109 entry. And we have shown the extra sheets fees as well.

to see if you qualify for an even greater reduction.

Conclusion

While not a huge discount you can save some money on a PCT application by filing it electronically or you may qualify for a much reduced fee if you reside in certain countries. It’s best to consult with your attorney.
