Trademarks

A trademark can be anything consumers recognize as being linked with a particular company and/or product/service, from a symbol (think Nike® swoosh symbol), a single word (think Apple®), or a phrase (think Things Go Better With Coke®) to an entire advertising campaign (think “Where’s the Beef?”). Brand recognition and repeat business can be fostered using trademarks.

Copyrights

Copyright law protects the owner of an “original work of authorship” against copying, adaptation, or other unauthorized uses from the time the work is put in a fixed form. As in all areas of law, this is a brief summary, and if you have a copyright issue, you should contact an attorney in a timely fashion, as rights and defenses can be lost.

Trade Secrets

Confidential material often contains significant intellectual property, significant business information, customer lists, technical know-how, and secret “ingredients” and procedures. These are often best protected as Trade Secrets. These Trade secrets are not public knowledge, unlike other forms of IP (intellectual property) such as copyrights, trademarks, and patents.
